1. Agreement to Terms
By engaging Classedge Agency for web design or digital services — whether through our website, WhatsApp, email or any other channel — you agree to be bound by these Terms of Service.
If you do not agree to these terms, please do not engage our services.
These terms apply to all clients of Classedge Agency, including those on one-time website packages and monthly care plans.
2. Our Services
Classedge Agency provides the following services:
- Custom website design and development (Starter, Popular and Premium packages).
- Monthly website care plans including maintenance, SEO, content updates and analytics reports.
- Domain name consultation and setup assistance.
- WhatsApp enquiry system integration.
- Firebase database setup and admin panel development.
- Google Analytics and Search Console setup.
Only what is listed under your chosen package on our Packages page is included in that price. Any request beyond that scope — extra pages, new features, or a redesign after final delivery — is treated as additional work and quoted separately before we begin.
3. Payment Terms
The following payment terms apply to all projects:
- Deposit: A 50% deposit is required before work begins on any website project.
- Final Payment: The remaining 50% is due upon completion and client approval of the website, before the site goes live.
- Care Plans: Monthly care plan fees are due at the beginning of each month. Failure to pay within 7 days may result in suspension of care services.
- Payment Methods: We accept M-Pesa and bank transfer. All prices are in Kenya Shillings (KSh) unless otherwise stated.
- No Refunds: Deposits are non-refundable once work has commenced. Final payments are non-refundable once the website has been delivered and approved.
4. Client Responsibilities
To ensure your project is delivered on time and to specification, you agree to:
- Provide all required content (text, images, logos, brand colours) within 7 days of project commencement.
- Respond to design feedback requests within 5 business days.
- Provide accurate business information to be displayed on your website.
- Ensure all content provided does not infringe on any third-party intellectual property rights.
- Notify us immediately of any changes to your business details, contact information or requirements.
You agree to indemnify and hold Classedge Agency harmless against any claim, loss or cost arising from content you supply that infringes a third party's rights.
⚠️ Project delays caused by late content delivery from the client do not entitle the client to a refund or discount.
5. Delivery Timelines
Estimated delivery timelines are as follows:
- Starter Package: 5–7 business days after receipt of all content.
- Popular Package: 10–14 business days after receipt of all content.
- Premium Package: 21–30 business days after receipt of all content.
These are estimates and not guarantees. Complex requirements, revisions or delays in content provision may affect delivery timelines.
6. Revisions & Changes
Each package includes a set number of revision rounds:
- Starter: 2 rounds of revisions.
- Popular: 3 rounds of revisions.
- Premium: Unlimited revisions within the agreed scope.
Revisions outside the agreed scope — including new features, additional pages or significant design changes — may be quoted and billed separately.
7. Intellectual Property
Upon full payment for a project:
- You own all content (text, images, logos) that you provided to us.
- You own the final website design and code delivered to you.
- Classedge Agency retains the right to display your completed website in our portfolio and marketing materials, unless you specifically request otherwise in writing.
We reserve the right to include a small "Built by Classedge Agency" credit in the footer of your website. This can be removed upon request for an agreed fee.
8. Hosting, Domain & Third-Party Services
- Websites are hosted on Netlify's free plan by default, with Firebase, EmailJS, Google Analytics and Search Console used for enquiries, forms and reporting where applicable.
- Domain names purchased on behalf of clients remain the property of the client and are registered in their name.
- Annual domain renewal fees are the client's responsibility unless covered under an active care plan agreement.
Classedge Agency does not control, and is not liable for, any outage, bug, security incident, policy change, or discontinuation of service by these third-party providers.
9. Monthly Care Plans
- Care plans run on a month-to-month basis with no minimum contract period.
- Either party may terminate the care plan with 14 days written notice via WhatsApp or email.
- Care plan fees paid for a current month are non-refundable upon cancellation.
- Classedge Agency reserves the right to adjust care plan pricing with 30 days written notice.
10. Limitation of Liability
Classedge Agency is responsible for correcting genuine errors in the work we deliver. Beyond that, we are not liable for:
- Any indirect or consequential losses — including lost sales, lost profits, lost opportunities, or reputational harm — arising from the use of, or any issue with, your website or our services.
- Third-party service outages (Netlify, Firebase, Google, WhatsApp, EmailJS).
- Security breaches resulting from vulnerabilities in third-party platforms or services.
- Content provided by the client that infringes third-party rights.
Our total liability to you for any claim — whether from breach of contract, negligence, or otherwise — is capped at the total amount you paid for the specific package or service giving rise to the claim.
11. Governing Law
These Terms of Service are governed by the laws of Kenya. Any disputes arising from these terms shall be resolved under Kenyan law and in Kenyan courts.
